1. Acceptance of Terms

By accessing or using GigHour, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

2. User Accounts

Registration: To use our platform, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Types: We offer separate accounts for employees and employers, each with specific rights and responsibilities.

3. Services Provided

GigHour provides a platform connecting employers with workers for short-term, gig-based employment opportunities. We facilitate:

  • Job posting and discovery
  • Application management
  • Payment processing
  • Communication between parties
  • Work tracking and verification

4. Employee Responsibilities & Code of Conduct

  • Provide accurate information about skills, experience, and availability
  • Complete accepted jobs to the best of your ability
  • Arrive on time and maintain professional conduct
  • Follow employer instructions and workplace safety guidelines
  • Report work completion accurately
  • Arrive in a sober state - consumption of alcohol or intoxicating substances before or during work is strictly prohibited
  • Maintain appropriate behavior and dress code as required by the job
  • Not engage in any illegal, unethical, or harmful activities during work
  • Respect the employer's property, premises, and other employees

Violation of Code of Conduct: Any violation of the above code of conduct may result in immediate termination of the job, non-payment for work, account suspension, and/or legal action as deemed appropriate.

5. Employer Responsibilities

  • Provide accurate job descriptions and requirements
  • Offer fair compensation for work performed
  • Ensure a safe working environment
  • Process payments promptly upon work completion
  • Treat workers with respect and professionalism

6. Payment Terms

For Employees: Payment will be processed after job completion and employer verification. Payments are subject to applicable taxes and processing fees.

For Employers: You agree to pay workers the agreed-upon amount for completed work. Failure to pay may result in account suspension or legal action.

Disputes: Payment disputes should be reported within 7 days of job completion. We will investigate and mediate fair resolutions.

7. Prohibited Activities

You agree not to:

  • Use the platform for any illegal purposes
  • Post false or misleading information
  • Harass, abuse, or harm other users
  • Attempt to circumvent payment processing
  • Share your account credentials with others
  • Use automated systems to access the platform
  • Collect user information without consent

8. Intellectual Property

All content, features, and functionality on the GigHour platform are owned by us and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

9. Limitation of Liability & Disclaimer

GigHour is solely a technology platform that facilitates connections between employers and workers. GigHour does not employ, supervise, or control any worker listed on the platform. By using our services, you acknowledge and agree to the following:

GigHour is NOT responsible or liable for:

  • The quality, timeliness, or completion of work performed by any employee
  • Any misconduct, negligence, fraud, theft, or illegal activities committed by employees
  • Any injuries, damages, losses, or harm (physical, emotional, or financial) occurring during or as a result of work
  • Disputes, conflicts, or disagreements between employers and employees
  • Any property damage, loss, or theft at the workplace
  • Any criminal acts or violations of law by any user of the platform
  • The accuracy of information provided by employees including skills, experience, or identity
  • Loss of data, service interruptions, or technical failures
  • Any consequential, incidental, indirect, special, or punitive damages

10. Employer's Assumption of Risk

By hiring any worker through GigHour, employers acknowledge and accept that:

  • The selection and hiring of any employee is entirely at the employer's own risk and discretion
  • GigHour does not verify, endorse, or guarantee the background, character, skills, or conduct of any employee
  • Employers are solely responsible for conducting their own due diligence, background checks, and verification before hiring
  • Employers must provide adequate supervision and safety measures at the workplace
  • Any insurance, worker's compensation, or liability coverage is the sole responsibility of the employer
  • GigHour shall not be held liable for any actions, omissions, or conduct of employees hired through the platform

11. Indemnification

You agree to indemnify, defend, and hold harmless GigHour, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of and access to the platform
  • Your violation of any term of these Terms of Service
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Any claim that your actions caused damage to a third party
  • Any dispute between you and another user of the platform

12. No Warranty

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. GIGHOUR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GIGHOUR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE PLATFORM DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED INDIAN RUPEES (₹100), WHICHEVER IS GREATER.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason, without prior notice or liability. You may also terminate your account at any time through the app settings. Upon termination, your right to use the platform will immediately cease.

15. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in English, and the seat of arbitration shall be Chennai, India. The arbitrator's decision shall be final and binding.

16. Changes to Terms

We may update these terms from time to time. We will notify you of any significant changes via email or app notification. Your continued use of the platform after changes constitutes acceptance of the new terms.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

19. Entire Agreement

These Terms of Service constitute the entire agreement between you and GigHour regarding the use of the platform, superseding any prior agreements between you and GigHour relating to your use of the platform.
